Sales Agreement

4. Deposits:

A minimum non-refundable deposit of $200 is required per puppy in order for it to be held for the Buyer. Deposits are transferable to another available puppy in the same litter or a puppy from another litter; upon approval of the Seller.  The remainder of the Buyer’s payment for a puppy is due in CASH or check when the Buyer picks up their puppy. No exceptions. If the puppy is shipped to the Buyer, the puppy must be paid for in FULL prior to it being shipped.  The Seller has the right to refuse the sale of a puppy to any customer, at any time, at the Seller’s sole discretion. If the Seller refuses to sell the puppy after a deposit has already been placed by the Buyer, the Seller will return the Buyer’s deposit in full.

5. Wellness Check:

This puppy must be taken to a licensed veterinarian within Five (5) business days from the date of receipt for a wellness check and, upon request, a report sent to Arbeitshunde German Shepherds. Any claims must be made within this time period and will be verified by Arbeitshunde German Shepherds’ own veterinarian. If said puppy is proven to have a life-threatening genetic defect, buyer will have the option of a replacement puppy and this puppy must be returned to Arbeitshunde German Shepherds within fourteen (14) days at the Buyer’s expense with all his/her paperwork, including a signed AKC certificate and all veterinary records.  Failure to see a veterinarian within five (5) days will void this agreement. 

The required vaccinations and worming are as indicated on the health record received by the Buyer at the time he/she takes possession of the puppy. Buyer agrees to maintain this dog in good health, provide routine preventative health care, including, but not limited to, inoculation, internal and external parasites and heart-worm preventative medication.

Seller agrees to provide the Buyer with a copy of the medical records for the puppy.  The health and temperament of this puppy is considered to be excellent to the best of the Seller’s knowledge and belief at the time of sale/transfer. The Buyer agrees to provide the puppy with the proper training and environment necessary for the puppy’s proper temperament development.  Buyer agrees to the terms: ________ (Initial)

 

6.  Hip Guarantee Agreement:

 Although it is impossible to guarantee a puppy will not get hip dysplasia, we make every effort to avoid such an occurrence by using stock that has been x-rayed and certified either via Schaeferhund Verein (SV), OFA, or PennHIP. Our policy on replacement is stated below.  Hip Dysplasia is a congenital malformation of the ball and socket joint of the hip. A dog may or may not become lame because of the disease depending upon its severity. In the event that one of our puppies develop CHD (Crippling hip-dysplasia – typically grade 2 or 3), we will do one of the following of the Buyer’s choosing: (1) The puppy is returned and we will replace the puppy with another puppy of equal value if the puppy is found to have moderate/severe hip dysplasia (grade 2 or 3) in which the disease is crippling. (2) Should the buyer wish to keep the puppy, they will be refunded 75% of the purchase price, (3) or receive a 50% discount on a 2nd puppy.  A certification of sterilization must be given before any replacement will be made by the seller, before the buyer receives a 50% discount on a 2nd puppy, or if the Buyer decides to keep the puppy and receive a 75% refund. Buyer agrees to maintain preventative care of the puppy in regards to hip dysplasia and overall health.  Buyer acknowledges they have been informed young bones do not properly calcify until twelve (12) months of age. Buyer acknowledges we will guarantee the hips until twenty-six (26) months of age, providing the buyer agrees they will not allow environmental conditions to adversely affect the development of the hip structure. Buyer will provide a certified, nutritionally complete food that will not promote excessive growth or obesity. Buyer will provide regular moderate exercise. The buyer is aware if they allow the dog to engage in activities that would stress the hips before the age of ten (10) months, then the hip guarantee becomes null and void. Activities include, but are not limited to, exercise on hard unyielding surfaces, continuous running, repetitive jumping, training in competitive dog sports, or any other activity that may cause injury.

If this puppy develops crippling hip dysplasia at any time from purchase to twenty-six (26) months of age (confirmed by X-rays from a competent licensed Veterinarian and the Veterinarian confirms that the puppy has also been given proper care), Arbeitshunde German Shepherds will request a copy of all x-ray films taken and a copy of the Veterinarian’s report.  The Seller reserves the right to request that the X-rays be sent first for review to a board-certified Veterinary Radiologist or other Veterinarian of the Seller’s choice.  At our discretion, we may request a second opinion X-ray to be taken (at our expense) by a veterinarian of our choice. 

If you choose a replacement puppy, it will be the same sex and from the next available litter, not necessarily of the same breeding. We breed a select number of litters per year and a replacement puppy may not be immediately available. In no instance is a full refund issued. Seller requires proof of spay/neuter of the dysplastic puppy before the guarantee will be honored.  If the alleged defect is proven to not be genetic but caused by trauma, stress or any other NON-inherited factor, this guarantee will not be honored.

Guarantee is not transferable. To make a claim against this Guarantee, the original Buyer who bought this puppy must still own the puppy.

The buyer, not Arbeitshunde German Shepherds, is responsible for all veterinarian bills, the costs associated with the return of a puppy and/or the replacement of a puppy.  Buyer agrees to the terms: _______________ (Initial)

 

7. Purchase & Transfer/Sale Agreement:

The Seller prefers to personally hand the puppy over to the Buyer in excellent, unquestionable health, but arrangements can be made for the puppy to be shipped at the Buyer’s expense. The Seller agrees to meet the Buyer within a 75 mile radius of the Seller’s current location for no additional fee, at a location agreed upon by both the Seller and the Buyer, or other arrangements can be made at the Seller’s discretion.

For the puppy’s protection, it will not leave the Seller’s possession prior to 8 weeks of age. This allows the puppy to reap the maximum benefit from its mother and ensures both the Buyer and Seller that the puppy is ready for its new home. 

The purchase price of $____.__ for the above mentioned puppy, including deposit, is mutually acknowledged by both Buyer and Seller. All sales are final and the puppy is being sold on an “As Is” basis, with the exception stated in the Health Guarantee above.

Buyer understands the puppy will be registered with AKC Limited Registration.  Buyer understands the purpose of Limited Registration, and agrees the dog will not be bred before the requirements are met for the Seller to agree to change the registration to full, allowing breeding.  Buyer understands if the puppy is sold on a FULL registration, meaning that said dog’s offspring can be registered through the American Kennel Club, Buyer agrees that before said dog is bred it will have achieved a minimum of two (2) titles through AKC and/or a working dog certification.  Said dog MUST also have hip and elbow joints certified as free of dysplasia by an accredited organization (OFA or SV).  Said dog shall also have no conformation or temperament faults.  Said dog shall ONLY be bred to an AKC purebred German Shepherd of equal or better quality and both dogs must display an exemplary stable temperament.  Buyer further agrees never to sell the offspring of said dog to a pet store or broker and will ensure that each puppy finds quality homes.  If this puppy is used for breeding without certified hip and elbow ratings (OFA or SV), bred to any dog other than an AKC German Shepherd, or without mentioned titles or certification the Seller may initiate a civil action in the amount of $5,000.00 in addition to attorney and court fees associated with said action. No further guarantee is made by the Seller or Buyer.

The requirement for changing the registration to FULL are as follows:  

        1. Two (2) AKC titles or working dog certifications (advanced agility, obedience, therapy, SAR,  or police, etc.

        2. OFA or SV (a-stamp) hip and elbow ratings.

        3. No faults to the standard in structure or temperament.

8. Performance:

Buyer acknowledges that Seller cannot guarantee that Puppy will achieve any particular titles (i.e. conformation championship, performance titles, etc.) Buyer is encouraged to notify Seller of any pertinent accomplishments of puppy, i.e. titles, awards, or other accomplishments recognized by the American Kennel Club or other registry or organization.  Buyer agrees to the terms: _______________ (Initial)

9. Liability:

The Buyer agrees that the Seller is not responsible for any injuries or neglect the puppy incurs after the purchase/transfer is made, or after. The Seller is not liable for any tests, medications or Veterinarian expenses and all Veterinarian/medical bills accumulated by the Buyer after transfer of the puppy is the financial responsibility of the Buyer.

The Buyer agrees that the Seller shall not be held financially or legally responsible/liable for any damages, physical injuries or emotional problems caused by the Buyer’s puppy. The Buyer agrees that the Seller shall not be held responsible for a puppy that is unruly, barks excessively, bites, digs or chews (which are all problems resulting from poor training, improper environment, and lack of guidance/socialization). 

Acceptance of puppy implies the Buyer is completely satisfied with and waives any and all claims regarding the Dog’s conformation and physical appearance.

10. Shipping Agreement:

a. Shipping is always in addition to the cost of the puppy and is the responsibility of the buyer. When shipping a puppy, Arbeitshunde German Shepherds and the buyer agree to the following terms:

i. Buyer assumes all risks and expenses of shipping, which includes a crate, airfare, health certificate and money for our fuel involved in the transport of the puppy (typically $350-$600 USD and up depending on crate size, weight, shipping fees, etc).

ii. We are in no way responsible for loss, death, or injury during transport of the puppy to the new home.

iii. Buyer will need to settle any disputes, should they arise, with the shipping company and NOT Arbeitshunde German Shepherds. 

iv. We are NOT responsible for associated changes which can occur due to shipping. These include stress, low blood sugar and loose stools.  Buyer agrees to the terms: _____________ (Initial)

 

11. Other Agreements:

Buyer is encouraged to send pictures and updates at four (4) months, six (6) months, twelve (12) months, eighteen (18) months and twenty-four (24) months of age. 

This dog is sold with the understanding that he/she will become a member of the family and treated as such. Buyer agrees to allow Arbeitshunde German Shepherds to use the dog’s name, picture and/or other information in advertising providing that we give the buyer recognition of ownership where appropriate. 12. Right of Refusal:

In the event the Buyer is unable to keep the puppy and decides to give it away to a new home, the Buyer agrees to give the Seller first option to take the puppy back, so the Seller can ensure that it is placed in a good home. 

This puppy is UNDER NO CIRCUMSTANCE to be surrendered to a shelter, humane society or a rescue group. BUYER AGREES TO NEVER GIVE, TRANSFER, OR SELL THE SAID PUPPY TO ANY PET SHOP, PET BROKER, HUMANE SOCIETY, OR LABORATORY. IF THE BUYER DISPOSES OF THE DOG IN VIOLATION OF THIS AGREEMENT, THE SELLER WILL INITIATE A CIVIL ACTION IN THE AMOUNT OF $2,000.00 IN ADDITION TO ATTORNEY AND COURT FEES ASSOCIATED WITH SAID ACTION.  Buyer agrees to the terms: ________________ (Initial)

13. Violations:

a. Violations of the terms of this contract renders all guarantees null and void and Arbeitshunde German Shepherds has the right to reclaim said dog without refund. Additionally, Arbeitshunde German Shepherds shall reclaim the dog without refund in the event that the dog is deemed to be abused, neglected or kept in an unsafe or cruel manner.  In this event, AKC registration must be signed over to Arbeitshunde German Shepherds and accompany the dog along with all current veterinary records to date. Should Arbeitshunde German Shepherds seek legal action against the buyer for violations of this agreement, the buyer will assume any and all expenses, including but not limited to, court costs, reasonable attorney fees, and veterinary costs that may be needed for the dog.  Buyer agrees to the terms: ________________ (Initial)

 

14.  Satisfaction Guarantee/Sale Agreement:

At Arbeitshunde German Shepherds, we strive to make all of our customers happy and satisfied with their buying experience and their new puppy. If for any reason the Buyer is not 100% satisfied with their puppy at the time of purchase or transfer, the Seller guarantees to try to resolve any issues within reason. Should a problem arise, the Buyer agrees to contact the Seller in writing (email preferred) and allow the Seller at least 30 days to resolve any and all matters before providing or posting any negative or slanderous information on the internet, news media, social media or on any public or private forum or entity. If such violation is committed by the Buyer or the Buyer encourages a third party to commit such acts, all guarantees are null and void and Seller may initiate a civil action in the amount of $1,000.00 in addition to attorney and court fees associated with said action. No further guarantee is made by the Seller or Buyer.

 

This contract is agreed upon by Buyer and Seller.

Both will sign and retain a copy for his/her records.
